Don't know about SuSE 10, but when I restarted Apache on my Gentoo machine recently, PHP behaved just the way you describe. I discovered that I had to make sure that Apache was being invoked with the -D PHP4 parameter. On Gentoo you do that by setting APACHE_OPTS in /etc/conf.d/apache2 -- hope that helps.
