No. Ruby is open source, written by one of the first/primary open
source advocates in Japan. I think the license is a variant of LGPL
(you can check at www.ruby-lang.org/en/LICENSE.txt)
I think Ruby has been used at least one other time as a language/product
name, and it's also possible that you're confusing it with something else
entirely.
