I'm fairly sure they already have a warning in the manual. While this
assumes that the user reads the manual, legally it shouldn't clear the
user from being responsible for using the product in accordance with the
instructions provided in that manual. If I decide to replace my video
card in my desktop computer without unplugging it and electrocute
myself, I cannot sue Apple because I was using the product in a method,
prohibited by the manual.
(Slightly anecdotal but...) If I'm listening to my third-generation iPod
in the car (using an iTrip FM Transmitter), I wouldn't be able to hear
it at all if I didn't have the volume on the iPod close to all the way
up.
I wouldn't feel so strongly about the lawsuit if this clown was only
suing for the iPod to be changed with Apple offering a recall. But suing
for cash damages in an unspecified amount, proves he's not someone
trying to change products for the common good, but just another idiot
abusing the legal system to make a quick buck.

I bought one of those MP3 players last week. I did think about possible
ear damage, and for that reason I usually don't play it at maximum
level.
The best thing apple could do is to print a warning label on the iPod's,
just like MacDonalds now does with their coffee.
