The article refers to this kind of incident as "data loss" (when they
say "sensitive information lost of stolen").

It seems like "loss" is the wrong word.  When I think of data loss, I
think of a failed hard drive without backups.  They obvoiously still
have the data, because they are reporting it to the credit card
companies.

I guess this is the logical extension of referring data copying as "theft".
