I suppose if we apprehended terrorists working on a nuclear bomb, and a technical expert reviewed their work and concluded that their plans were rather poor and could never have resulted in a working H bomb, we should let them go and apologize for inconveniencing them.


You really want to set a precedent that refreshing a web page is an attack? My life would be hell if carfax.com got DDoS'd (until we got the culprits blocked), but not even I'm willing to go that far. At that point sites like Slashdot and Digg could be liable for all sorts of civil action, and I don't see that as acceptable.
