Fair enough, but note that the University *can* charge law (and
other professional schools) students tuition by that same law.  Just 
not everybody.  Which is another reason why they lost the case.  
Arguing that "gosh, only the professional students really pay 
tuition; everybody else just pays fees" sounds pretty lame.

While I feel that the administration's legal counsel bears some 
responsibility, it's probably the case that lots of places could 
(and are) burned by somebody conjuring up 100-year-old laws that 
nobody has cared about in 50 years.
